Juniorsk\u00fd maratonsk\u00fd klub, z.s. and RunCzech s.r.o.<\/strong><\/h3>\n\n\n\n

I. Introductory provisions<\/h3>\n\n\n\n
    \n
  1. Juniorsk\u00fd maratonsk\u00fd klub, z.s., with registered offices at Franti\u0161ka K\u0159\u00ed\u017eka 461\/11, Hole\u0161ovice, 170 00 Prague 7, Company Reg. No.: 22902147, recorded in the Commercial Register maintained by the Municipal Court in Prague, section C, insert 36777 (hereinafter also referred to as the \u201cOrganiser\u201d), is the organiser of the following RunCzech running races: The Prague Half Marathon, the Prague Relay, the Marathon Weekend and the Birell Prague Grand Prix (herein referred to as the \u201crace\u201d).<\/li>\n\n\n\n
  2. RunCzech s.r.o, with offices at Franti\u0161ka K\u0159i\u017e\u00edka 461\/11, Hole\u0161ovice, 170 00 Prague 7, Company Reg. No.: 251 07 615, recorded in the Commercial Register maintained by the Municipal Court in Prague, section C, insert 50213 (hereinafter referred to as the \u201cOrganiser\u201d) is the organiser of regional RunCzech Running League races: The Mattoni Karlovy Vary Half Marathon, the Mattoni \u010cesk\u00e9 Bud\u011bjovice Half Marathon, the Mattoni Olomouc Half Marathon and the Mattoni \u00dast\u00ed nad Labem Half Marathon, the Mattoni Liberec Nature Run (hereinafter referred to as the \u201crace\u201d).<\/li>\n\n\n\n
  3. The Terms and Conditions of the aforementioned Organisers (hereinafter referred to as the \u201cTerms\u201d) are governed in accordance with the provisions of Section 1751 (1) of Act No. 89\/2012 Coll., The Civil Code, the mutual rights and obligations arising between the individual Organiser of a\u00a0race in connection with or based on participant registration for a\u00a0race or races organised by a\u00a0specific Organiser via the Organiser\u2019s website operated on\u00a0runczech.com<\/a>\u00a0(hereinafter referred to as the \u201cweb interface\u201d between the Organiser and the Participant \u2013 Natural Person (hereinafter referred to as the \u201cParticipant\u201d). For the purposes of these Terms and Conditions, the Organiser shall always be considered the entity referred to in Articles 1 and 2, which is the organiser of a\u00a0specific race for which the Participant has registered.<\/li>\n\n\n\n
  4. Only duly registered participants meeting the conditions required for participation in the Race arising from these Terms and Conditions and from the binding rules of the Race available at\u00a0https:\/\/www.runczech.com\/srv\/www\/pravidla-en<\/a>\u00a0(„Rules of the Race“) may participate in the Race. Based on the registration of the Participant, the Organizer enables participation in the Race and provides other related services ordered. By registering for the Race via the website, the Participant confirms that he\/she has read these Terms and Conditions and the Rules of the Race, and that he\/she agrees with them.<\/li>\n\n\n\n
  5. The Organiser also enables registration to races along with other relevant associated services via contractual sellers acting on the basis of contracts entered into with them. These Terms proportionately relate to natural persons who registered for a\u00a0race through these contractual sellers.<\/li>\n<\/ol>\n\n\n\n

    II. Entering into a contract<\/h3>\n\n\n\n
      \n
    1. The Participant orders services from the Organiser by completing and sending a\u00a0registration form via the web interface at www.runczech.com.<\/li>\n\n\n\n
    2. To register for the race via the web interface requires a\u00a0so-called RunnersID, a\u00a0user account for the participant,\u00a0which also includes the participant’s email address.<\/li>\n\n\n\n
    3. When registering on the web interface, the Participant is obligated to disclose the correct and truthful data. The Participant is obligated to maintain all data indicated on the registration form updated.<\/li>\n\n\n\n
    4. The registration form above all contains the following relevant information:\n
        \n
      1. Participant name, surname, gender, date of birth, address and nationality,<\/li>\n\n\n\n
      2. Selected payment method<\/li>\n<\/ol>\n<\/li>\n\n\n\n
      3. It is possible to use the RunnersID account register on behalf of a\u00a0Participant with another RunnersID, also on one occasion on behalf of a\u00a0person without a\u00a0RunnersID account. In this case, the Terms apply to the person whose RunnersID is used to make the registration and that person is responsible for accepting the Terms on behalf of the registered Participant.<\/li>\n\n\n\n
      4. The Participant agrees to use remote means of communication when entering into the contract. The costs incurred by the Participant in using remote communication means in connection with entering into the contract (costs of internet connection, etc.) shall be borne by each Participant himself \/ herself.<\/li>\n\n\n\n
      5. The Contract is entered into upon acceptance of the registration form by the Organiser, which is sent to the Participant by e-mail to the Participant\u2019s e-mail address and by payment of the price in accordance with Article III of these Terms and Conditions.<\/li>\n\n\n\n
      6. The ordering of all relevant associated services (insurance, t-shirt, medal engraving, etc.) must be included on the registration form. It is not possible to order these at a\u00a0later date<\/li>\n<\/ol>\n\n\n\n

        III. Price and payment terms<\/h3>\n\n\n\n
          \n
        1. The price for Organiser services comprises the price for participating in a\u00a0race (here referred to as the \u201cstart fee\u201d) and the price for the relevant associated services (insurance, t-shirt, medal engraving etc.).<\/li>\n\n\n\n
        2. The price for Organiser services may be paid by the Participant in one of the following ways:\n
            \n
          1. card payment via a\u00a0secure online gateway (card online);<\/li>\n\n\n\n
          2. payment by bank transfer;<\/li>\n\n\n\n
          3. cash \/ card payment at the Organiser\u2019s address.<\/li>\n<\/ol>\n<\/li>\n\n\n\n
          4. Individual payment methods are offered and accepted pursuant to current availability, or according to what kind of specific service it relates to and the time of registration. The Participant respects the options offered on the web interface.<\/li>\n\n\n\n
          5. In the event of payment by bank transfer, the Participant is obligated to pay the price along with indicating the variable symbol of the payment within ten calendar days from when the registration form has been accepted by the Organiser.<\/li>\n\n\n\n
          6. In the event of cashless payment by bank transfer and payment by card via the online secure payment gateway, the Participant’s obligation to pay the price is met when the relevant amount is credited to the Organiser’s account.<\/li>\n\n\n\n
          7. In the event of cash\/card payment at the Organiser\u2019s address, the Participant\u2019s obligation to pay the price is met at the point of paying the sum in cash \/confirmation of payment at the pay terminal.<\/li>\n\n\n\n
          8. The Organiser notifies the Participant of making payment through electronic communication to the email address indicated by the participant, resp. registrar on the registration form.<\/li>\n\n\n\n
          9. The price is final, non-refundable and cannot be transferred to another race.<\/li>\n\n\n\n
          10. Any discounts which are not claimed on the registration form, cannot be claimed retrospectively.<\/li>\n\n\n\n
          11. In the event that the price is not paid within 10 calendar days of the registration form being accepted by the Organiser, the participant\u2019s registration will be automatically cancelled and all the associated orders will expire.<\/li>\n\n\n\n
          12. The price for race registration accepted by the Organiser less than 12 days before a\u00a0race needs to be paid no later than 6 days ahead of the race.<\/li>\n\n\n\n
          13. In case of registering with the registration code issued for the canceled race in 2020, the Participant must use and register with this voucher no later than last Tuesday before the Race of 2021 (in case of registration code for the race of 2021), or in 2022 (in the case of the registration code for the race of 2022), otherwise the right to use the voucher expires without any further compensation.<\/li>\n\n\n\n
          14. The price for Organiser services i.e. the price for participating in a\u00a0race (hereinafter referred to as the \u201cstart fee\u201d) and the price of relevant associated services is non-refundable. Participants can take advantage of\u00a0cancellation insurance for race participation<\/a>.<\/li>\n\n\n\n
          15. Participants can also take advantage of\u00a0pre-registration<\/a>\u00a0to another race Participant, only by following the procedure and in accordance with the rules accessible on\u00a0https:\/\/www.runczech.com\/en\/for-you\/for-runners\/rules-and-general-information-1\/index.shtml<\/a>.<\/li>\n<\/ol>\n\n\n\n

            IV. Other rights and obligations of the contracting parties<\/h3>\n\n\n\n
              \n
            1. Based on registration payment in accordance with this Article III of these Terms and Conditions, provided that other conditions stipulated for participation in the Race are met, the Organizer will enable the Participant to participate in the Race by issuing him\/her a\u00a0competition number which the Participant shall collect in accordance to the instruction of the Organizer, and the Organizer shall provide the Participant with other related services ordered.<\/li>\n\n\n\n
            2. The Participant acquires the right to participate in the Race by paying the full price of the registration fee to the Organizer, or by confirming the order using the registration code issued by the Organizer, and meeting other conditions for provision of services specified by the Organizer in the Rules of the Race (rules of participation in the Race, collecting a\u00a0competition number, which the Participant shall collect and place visibly on top of his\/her clothes, etc.) available at\u00a0https:\/\/www.runczech.com\/srv\/www\/pravidla-en<\/a>, which the Participant shall read before registration and respect and abide by them. In the event that the Participant does not respect and abide by these binding rules, the Organizer is not obliged to allow the Participant to participate in the Race and provide related services.<\/li>\n\n\n\n
            3. In case of cancellation of the Race due to force majeure, ie extraordinary, unforeseeable, unavoidable event not caused by the Organizer (eg extreme climatic conditions, breakdown, epidemic of contagious disease, etc.), or due to regulation or binding measure of public authority preventing or restricting organization of the Race in the usual scope or quality, the Participant, with regard to the costs incurred to the Organizer in connection with the preparation of the Race, has no right to a\u00a0refund of the registration fee. If the Race is canceled for another reason, it is possible to request a\u00a0refund or a\u00a0transfer of the registration fee to another race from the notification date of the Race cancellation up to 14 days after the originally scheduled date of the Race, if the capacity of the selected race is not yet full.<\/li>\n\n\n\n
            4. In case of an extraordinary, unforeseeable, unavoidable and unintentional event that could endanger the safety or health of participants of the Race, or as a\u00a0result of regulations or measures of public authority, the Organizer reserves the right to change, modify or shorten the distance of the Race, or change the schedule or the date of the Race. In such a\u00a0case, the Participant is not entitled to a\u00a0refund of any part of the registration fee or any other compensation.<\/li>\n\n\n\n
            5. The Organiser is not liable for any personal injury, damage to property or any other harm arising from participation in the race.<\/li>\n\n\n\n
            6. The Organizer reserves the right to adjust the scope of additional services provided during the Race with regard to the current epidemiological situation, weather conditions and effective regulations or measures of public authorities or the Organizer (accompanying program, range of refreshment stations, etc.) during the Race.<\/li>\n\n\n\n
            7. The Participant has the right to assert his \/her rights due to errors in the relevant associated services in accordance with the provisions of Section 1914 et seq. of Act No. 89\/2012 Coll., of the Civil Code. The Participant may exercise these rights with the Organiser at the company\u2019s registered offices (Franti\u0161ka K\u0159\u00ed\u017eka 11, Hole\u0161ovice, Prague 7), from Monday to Friday from 09.00 to 17.00, or at the same address, electronically at\u00a0info@runczech.com<\/a>\u00a0or by phone +420 224 919 209<\/li>\n<\/ol>\n\n\n\n

              V. Contract withdrawal<\/h3>\n\n\n\n
                \n
              1. The Participant acknowledges that contract withdrawal, i.e. the legal relationship arising between the Participant and the Organiser based on registration and payment of the price in accordance with Article III of these Terms and Conditions, as a\u00a0leisure contract which the Organiser provides within a\u00a0stipulated deadline, is not possible in accordance with provision \u00a7 1837 point. j) of Act No. 89\/2012 Coll., of the Civil Code.<\/li>\n<\/ol>\n\n\n\n

                VI. Protection of personal data<\/h3>\n\n\n\n
                  \n
                1. The protection of personal data of the Participant is provided on the basis of Regulation (EU) 2016\/679 of the European Parliament and the European Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95\/46 \/ EC (General Regulation on Personal Data Protection) and Act No. 110\/2019 Coll. about the processing of personal data.<\/li>\n\n\n\n
                2. The following Participant personal data will be processed based on race registration: name and surname, residency address, e-mail address, telephone number and delivery address (hereinafter referred to jointly as \u201cpersonal data\u201d) indicated on the registration form.<\/li>\n\n\n\n
                3. Based on legitimate interest, the Organiser will process the following Participant personal data: gender, date of birth, athletics club, nationality, profession assigned start number.<\/li>\n\n\n\n
                4. The Participant acknowledges the processing of personal data by the Organiser, essential for fulfilling the rights and obligations of the contract, i.e. to organise and carry out the race, including the recording of race results and to maintain the RunnersID account.<\/li>\n\n\n\n
                5. The Participant has the right to decline the receipt of marketing communications on behalf of the Organiser.<\/li>\n\n\n\n
                6. The Participant acknowledges that s\/he is obligated to provide truthful and accurate personal data (when registering, in his\/her user account, when making orders on the web interface) and that s\/he is obligated to notify the Organiser without undue delay as to any changes to his\/her personal data.<\/li>\n\n\n\n
                7. The Organiser may entrust the processing of personal data, to the same scope and for the same purpose, to a\u00a0third party in the role of processor based on a\u00a0duly drafted processing contract.<\/li>\n\n\n\n
                8. By submitting his\/her completed registration, the Participant has acknowledged the Information on personal data processing issued by the Organiser, which continues to be available at any time on\u00a0https:\/\/www.runczech.com\/en\/useful\/for-public\/gdpr\/index.shtml<\/a><\/a><\/li>\n\n\n\n
                9. By completing and submitting the registration form, each race Participant grants consent free of charge to make and use and to process visual and audio recordings of his \/ her person, his \/ her portrait and other expressions of a\u00a0personal nature made in connection with the race e. above all taken prior to the race, during the race and at the finish line in any form and without restrictions for the marketing, advertising and promotional purposes of the Organiser, their activities, events and races organised by the Organiser or in collaboration with them, as well as for the marketing, advertising and promotional purposes of their business partners without any entitlement to remuneration. The Participant also grants permission to use and distribute visual and audio recordings of his \/ her person, his \/ her portrait, and other expressions of a\u00a0personal nature made in connection with the race and their copies in any form for advertising and promotion of the Organiser (brochures, posters, billboards), electronic media (internet) and audio-visual advertising spots.<\/li>\n<\/ol>\n\n\n\n

                  VII. Contact points<\/h3>\n\n\n\n
                    \n
                  1. The Organiser provides telephone and e-mail support, assistance in registering for the race and race-related information 5 days a\u00a0week (Mon-Fri) from 9 am to 6 pm at\u00a0info@runczech.com<\/a>, +420 224 919 209. The Organiser reserves the right to restrict operations during emergencies and for operational reasons.<\/li>\n<\/ol>\n\n\n\n

                    VIII. Final provisions<\/h3>\n\n\n\n
                      \n
                    1. The legal relationships which emerge in connection with or on the basis of race registration set up by the Organiser will be settled exclusively under the law of the Czech Republic.<\/li>\n\n\n\n
                    2. Each Participant has the right to settle any disputes arising as a\u00a0result of or in connection with race registration out of court. A\u00a0precondition for an out-of-court dispute resolution is an unsuccessful attempt to settle the dispute directly between the Participant and the Organiser. For this purpose, the Participant is entitled to appeal with a\u00a0proposal to initiate an out-of-court settlement of a\u00a0consumer dispute containing the particulars referred to in Section 20n of Act No. 634\/1992 Coll. on Consumer Protection at the Czech Trade Inspection Authority, based in Prague 2, \u0160t\u011bp\u00e1nsk\u00e1 567\/15,\u00a0www.coi.cz<\/a>. Both submission of the proposal and subsequent participation in the out-of-court settlement of the dispute shall be free of charge to the Participant, and any costs incurred in connection with the out-of-court settlement of the dispute shall be borne separately by each party. An application for an out-of-court settlement of a\u00a0dispute may be filed no later than one year from the date when the Participant first lodged a\u00a0claim with the Organiser, who is the subject of the dispute.<\/li>\n\n\n\n
                    3. The Organiser may change or supplement the wording of these Terms and Conditions. This provision does not affect the rights and responsibilities of the Organiser and the Participant which arose during the effective period of the previous version of the Business Terms and Conditions<\/li>\n\n\n\n
